Article 2 – Applicability
- These terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
- Before the contract is concluded, the text of these terms and conditions shall be made available to the consumer in digital form.
Article 3 – The offer and the contract
- If an offer is valid for a limited period or is subject to conditions, this will be expressly stated.
- Obvious errors or mistakes in the offer (such as blatant pricing errors) are not binding on the trader.
- The contract is concluded upon acceptance by the consumer and fulfilment of the conditions set out therein.
Article 4 – Right of withdrawal (cooling-off period)
- When purchasing products, the consumer has the right to withdraw from the contract without giving any reason within 14 days provided that the items are unopened, unused and undamaged.
This period begins on the day after the product is received. - During the cooling-off period, the consumer must handle the product and its packaging with care. The product may only be unpacked to the extent necessary to assess whether the consumer wishes to keep it (as would be the case in a high-street shop).
- Exception: Products which, for reasons of hygiene or health protection, cannot be returned once opened, or which, by their very nature, have become irreparably mixed (such as opened liquids or maintenance products from Purus Carwash), are excluded from the right of withdrawal if the seal has been broken.
Article 5 – Costs in the event of withdrawal
- If the consumer exercises their right of withdrawal, they shall be responsible for the delivery and return postage costs.
- The trader shall refund the full order amount, excluding the initial delivery charges, as soon as possible, but no later than 14 days after the goods have been returned.
Article 6 – Price and Payment
- The prices quoted in the product range include VAT.
- Price changes resulting from external factors (such as changes to VAT) may be passed on at any time.
- The consumer must make the payment directly via the online shop using the payment methods provided (iDEAL, credit card, etc.).
Article 7 – Delivery and performance
- The trader shall exercise the utmost care when accepting and fulfilling orders.
- The place of delivery shall be the address that the consumer has provided to the company.
- The trader endeavours to deliver within the timeframe stated on the website. If a delivery is delayed, the consumer will be notified of this within 30 days at the latest.
- The risk of damage to and/or loss of products remains with the trader until the moment of delivery to the consumer, unless expressly agreed otherwise.
Article 8 – Warranty and Conformity
- The trader guarantees that the products comply with the contract and the specifications set out in the offer.
- The consumer must report any defects in the products supplied to the trader in writing within a reasonable period of time (no later than two months) after discovery.
Article 9 – Complaints Procedure and Disputes
- Complaints regarding the performance of the contract must be submitted to the trader, setting them out fully and clearly.
- Contracts between the trader and the consumer are governed exclusively by Dutch law.
